These Terms of Use and the Privacy Statement are an agreement that govern your use of BASIS Charter Schools, Inc. Site (the “Site”). Additional terms and conditions of use applicable to specific areas of the Site may also be posted on the Site. These Terms of Use, the Privacy Policy and any additional terms posted on the Site are referred to as the “Agreement”. By accessing and using the Site, you acknowledge that you have reviewed and agree to be bound by this Agreement in connection with your use of the Site. BASIS Charter Schools, Inc. reserves the right to modify or supplement any or all of the terms of this Agreement from time to time without notice to you. BASIS Charter Schools, Inc. reserves the right, in its sole discretion, to restrict, suspend or terminate access to all or any part of the Site or to change, suspend or discontinue all or any aspect of the Site, including the availability of any feature, database, information or content, at any time and without prior notice or liability. You are not authorized to use this Site in any jurisdiction where the terms of this Agreement are not enforceable.

Content – The Site includes articles and information which we believe will be of interest to our users. Some of the articles and information have been developed by BASIS Charter Schools, Inc. Other articles and information are provided by third-party sources. We cannot ensure that information provided on the Site is accurate, exhaustive or complete on every subject or that it will necessarily include all of the most recent information available on a particular topic. You are solely responsible for use of and reliance on this information. Information, software, text, photographs, graphics, links and other material (collectively, the “Content”) provided on the Site are protected by copyright, trademark or other proprietary rights of BASIS Charter Schools, Inc. or of third parties. BASIS Charter Schools, Inc. grants you a limited nonexclusive license to use the information on the Site for your personal and noncommercial use. You may download or copy the Content for personal use only, provided that you maintain all copyright and other notices contained therein. Registration – To use portions of the Site, you must be registered and provide personal data including contact information. You agree to provide true and accurate information in connection with your registration and to promptly notify us of any changes in the registration information. This Site is not intended for use by persons under the age of 18. You are fully liable for all use of the Site accessed through your registration information, including any use by a user not authorized by you who accesses the Site using your registration information. You should promptly notify us of any unauthorized use of your registration information or other breach of security.

Contacts with Other Sites – BASIS Charter Schools, Inc. may include or provide links on the Site to other sites on the Internet, which may include information, opinions or recommendations of various individuals, organizations or companies. You acknowledge and agree that BASIS Charter Schools, Inc. has no control over such sites and is not responsible for the availability of such external sites. Exchange of Information – In connection with using the Site, you may provide or receive information by email. Although email is generally reliable, email can be transmitted improperly or wrongfully intercepted. Indemnification – You agree to indemnify, defend, and hold BASIS Charter Schools, Inc. harmless from and against any and all claims from third parties arising out of or in any way related to and any and all claims, losses, damages and expenses (including attorneys’ fees) resulting from your use of the Site or breach of these terms and conditions, regardless of the form of action. You agree that any supplier of any portion of the Content shall be entitled to enforce its rights against you as though that supplier is a party to these terms and conditions.

General Terms – This Agreement, all intellectual property issues, and your rights and obligations shall be governed by the laws of the United States of America and the State of Arizona governing contracts wholly entered into and wholly performed within Arizona and any action to enforce these terms and conditions or in any manner related to BASIS Charter Schools, Inc. shall be brought exclusively in the federal or state courts located in Phoenix, Arizona and you agree to submit to the jurisdiction of such courts.

This Agreement constitutes the entire agreement between you and BASIS Charter Schools, Inc. with respect to the Site, and supersedes all previous written or oral agreements with respect to such subject matter. If any inconsistency exists between the terms of this agreement and any additional terms and conditions posted on the Site, the terms shall be interpreted as to eliminate any inconsistency, if possible, and otherwise, the additional terms and conditions shall control. The provisions of this Agreement will be deemed severable and the invalidity or unenforceability of any provision will not affect the validity or enforceability of the other provision hereof. Any provision determined to be invalid or unenforceable will be modified, to the extent possible, to be valid and enforceable so as to retain the intent of the parties.

BASIS Charter Schools, Inc. is strongly committed to protecting all information collected through this Site. The following privacy statement (“Statement”) discloses the privacy practices for www.basisschools.org (“Site”), a Site owned and operated by BASIS Charter Schools, Inc. BASIS Charter Schools, Inc. reserves the right to change the privacy statement at any time.

Automatically collected information – the Site automatically collects publicly accessible information from users’ browsers such as browser type, IP address, and a host name. This information is used for fine-tuning and trouble-shooting purposes.

Cookies – the Site does not use any persisting cookies to store information on your computer. Instead the platform utilizes “session cookies,” which store encrypted authentication information in the browser memory for the duration of a specific session. After the browser is closed, all cookies will be deleted.

Personal information – To access and use certain portions of the Site, you must provide personally identifiable information. Personally identifiable information means any information that is associated with your personal identity such as address, telephone number, user Ids, passwords, email address, billing and payment information and communications records. You can make changes to this information by following the directions on the Site. You must be over 18 to register and use the Site. We will not intentionally collect or use personal information from users that we have reason to believe are under 18 years of age.

BASIS Charter Schools, Inc. has implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. The Site will not share or distribute any Data, except (1) for the purpose of communicating with you when it is necessary for completing the transactions you have authorized, including but not limited to providing such information to data processors or mailing services, (2) when it is necessary for employees, agents and contractors to operate or maintain the Site or to correct a technical problem; (3) when it is necessary to verify the existence or condition of your account with a financial institution, credit bureau or other third-party; (4) for abuse management or when it is permitted or required by law, including but not limited to responding to a court order or compliance with any regulatory authority; or (5) as permitted by the Family Educational Rights and Privacy Act (“FERPA”).

Under special circumstances we may, and you authorize us to, disclose personally identifiable information without your consent if we believe, in our sole discretion, it is reasonable to do so to satisfy laws (such as the Electronic Communications Privacy Act, as amended) or government regulations, comply with legal process or law enforcement requests, commence legal actions for violation of the Site or to protect BASIS Charter Schools, Inc.’s rights or property.

When users submit sensitive information via the Site, BASIS Charter Schools, Inc. uses commercially reasonable efforts to protect their information both online and offline. However, we cannot guarantee that unauthorized third parties will never be able use your personal information for improper purposes. Thus, you acknowledge that you provide your personal information at your own risk.

Security – We use reasonable precautions to secure the personally identifiable information we maintain about you on computer servers in an appropriately controlled, secure environment. All transactions on the Site are protected by encryption software called SSL up to 256-bit encryption if accessed through Microsoft Internet Explorer 5.5, Mozilla Firefox 1.0, and Netscape Navigator 6.0 and higher. If and when our registration and payment forms asks users to enter sensitive information (such as credit card number and/or Social Security number), that information will be encrypted and protected with SSL. While we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegally obtaining this information. BASIS Charter Schools, Inc. is not responsible for any breach of its security or for the actions of any third parties that may obtain any personal information. You are prohibited from violating or attempting to violate security for or otherwise interfering with the operation of the Site. You may not access information not intended for your use or access.

While we use SSL encryption to protect sensitive information online, we will use commercially reasonable efforts to protect personal user information offline. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) will be granted access to personally identifiable information.

External links – The Site may contain links to a third-parties web sites; BASIS Charter Schools, Inc. is not responsible for content of these sites, nor their privacy practices. Every visitor should check these sites’ privacy statements before submitting any information.

We may change this Policy from time to time to take into account new or changing circumstances. By using this Site, you agree to the terms of this Privacy Statement and consent to receive notice of any changes to this Privacy Policy by postings on the Site or by email, as determined by BASIS Charter Schools, Inc.

Pursuant to California law, our California customers may request certain information regarding our disclosure, if any, of your personally identifiable information to third parties for their direct marketing purposes during the preceding calendar year. BASIS is committed to providing a school environment that ensures the equality, dignity, and respect of every student. An adult registered sex offender is not allowed on school property, including school buildings, grounds, and vehicles, except under the following limited circumstances

When the offender is the parent/guardian of a student attending the school and the offender is:

      1. Attending a meeting with school personnel to discuss the academic progress, social progress, or discipline of the offender’s child; or
      2. Participating in team meetings in which special education evaluation and placement decisions may be made with respect to the offender’s child; or
      3. The offender has obtained prior written permission from the Head of School.

When a registered sex offender is present on school property under any of the circumstances described above, the offender must:

      1. Notify the Head of School prior to and immediately upon arrival on school property;
      2. Remain at all times under the direct supervision of the Head of School or a person designated by the Head of School; and
      3. Notify the Head of School when the offender is departing from school property

In compliance with McKinney Vento Act, the Registrar at each campus is appointed the homeless children liaison for that school. The Registrar shall ensure legal compliance with all applicable federal and state laws and regulations regarding homeless children.
